Kingsbury Carpet Cleaners Service Terms and Conditions

These Terms and Conditions set out the basis on which Kingsbury Carpet Cleaners provides carpet, upholstery and related cleaning services to residential and commercial customers within its service area. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Client means any individual or organisation that requests or purchases services from Kingsbury Carpet Cleaners.

Company means Kingsbury Carpet Cleaners, the provider of the services.

Services means carpet cleaning, rug cleaning, upholstery cleaning, stain treatment, related cleaning services and any other services agreed in writing between the Client and the Company.

Premises means the property or location where the Services are to be carried out.

Booking means a confirmed appointment for the Company to provide Services at the Premises.

2. Scope of Services

The Company provides professional cleaning services including, but not limited to, carpet cleaning, rug cleaning, upholstery cleaning, spot and stain treatment, deodorising and related services as described at the time of booking. The Company will use reasonable skill and care in delivering the Services and will aim to achieve the best possible result taking into account the age, condition and material of the items being cleaned.

The Company does not guarantee the removal of all stains or odours. Some stains and odours are permanent in nature and may not respond fully to any form of cleaning treatment. Any estimate of likely results given before or during the service is an opinion only and not a guarantee.

3. Booking Process

Bookings can be made by the Client through the Companys accepted communication methods. A Booking is not confirmed until the Company has provided confirmation to the Client and, where required, a deposit has been received.

The Client is responsible for providing accurate information at the time of booking, including the type and approximate size of areas or items to be cleaned, any particular concerns or special requirements, and details of access to the Premises. The Company reserves the right to amend the quoted price or decline the job if information provided at the time of booking is materially inaccurate.

The Company will allocate a date and time window for the Booking. Any times given are estimates only. While the Company will use reasonable efforts to attend at the agreed time, delays may occur due to traffic, weather or prior jobs overrunning. If the Company expects a significant delay, reasonable efforts will be made to inform the Client as soon as practicable.

4. Access to the Premises

The Client must ensure that the Company has safe and reasonable access to the Premises for the duration of the Booking, including suitable parking for the Companys vehicle and equipment where required. Any parking fees or congestion charges incurred as a direct result of performing the Services may be added to the Clients invoice.

The Client or a responsible adult authorised by the Client must be present at the Premises at the start and end of the service, unless otherwise agreed in advance. If the Company attends the Premises and is unable to gain access, a call-out fee or cancellation charge may apply as set out in these Terms and Conditions.

5. Client Responsibilities

The Client is responsible for:

Ensuring that the Premises are safe for the Companys operatives to work in, including notifying the Company of any health and safety risks.

Removing fragile, valuable and personal items from the areas to be cleaned prior to the Companys arrival.

Securing pets and children away from the work area and equipment throughout the service.

Advising the Company in advance of any known issues with carpets, rugs or upholstery, such as previous colour damage, shrinkage, loose seams, or manufacturer care instructions.

The Company will not be liable for damage arising from risks that were not disclosed or that could not reasonably have been identified by visual inspection.

6. Estimates and Quotations

Any prices provided prior to inspection of the Premises are estimates only, based on the information supplied by the Client. The final price will be confirmed once the Company has inspected the items and areas to be cleaned on arrival at the Premises. If the Client declines to proceed at the revised price, a call-out charge may apply to cover the Companys costs.

All prices are given inclusive or exclusive of any applicable taxes as clearly stated at the time of quotation. The Company reserves the right to revise prices to reflect changes in tax rates or other regulatory charges.

7. Payments

Unless otherwise agreed in writing, payment is due immediately upon completion of the Services at the Premises. The Company may accept various payment methods as notified to the Client in advance or at the time of service. The Client agrees to ensure that full payment is available at the time payment is due.

For certain bookings, including but not limited to larger commercial works or multiple property bookings, the Company may require a deposit or advance payment. Any such requirement will be communicated to the Client at the time of booking. Deposits may be non-refundable as set out in the cancellation section of these Terms and Conditions.

If payment is not made when due, the Company reserves the right to charge interest on the outstanding amount at the statutory rate from the due date until payment is received in full. The Client shall be responsible for all reasonable costs incurred by the Company in recovering any overdue sums.

8. Cancellations and Rescheduling

The Client may cancel or request to reschedule a Booking by contacting the Company through its accepted communication channels. The following terms apply unless otherwise agreed in writing:

If the Client cancels more than 48 hours before the scheduled start time, any deposit paid may be refunded or transferred to a new booking at the Companys discretion.

If the Client cancels within 24 to 48 hours of the scheduled start time, the Company may retain part or all of any deposit paid, or charge a cancellation fee to cover administrative and scheduling costs.

If the Client cancels within 24 hours of the scheduled start time, or if the Company attends the Premises and is unable to gain access or proceed with the work due to circumstances within the Clients control, the Company may charge up to the full quoted price.

The Company will use reasonable efforts to accommodate rescheduling requests, but cannot guarantee availability for alternative dates and times.

The Company reserves the right to cancel or reschedule a Booking due to circumstances beyond its reasonable control, including but not limited to severe weather, equipment breakdown, staff illness or access issues. In such cases, the Company will offer an alternative appointment date. Any deposit paid will remain valid for the rescheduled booking or may be refunded at the Companys discretion if no suitable alternative can be arranged.

9. Condition of Items and Results

The Client acknowledges that the success of any cleaning process depends on the type of fibre, age, condition, construction and previous treatment of the carpets, rugs or upholstery. The Company will conduct a pre-inspection where practicable, but some conditions may only become apparent during or after cleaning.

The Company does not guarantee against wear, colour loss, shrinkage, pile distortion, texture change, loose or weakened seams, fraying or any pre-existing damage that may be revealed or worsened by the cleaning process. The Company will take reasonable care to test for colour fastness, but cannot be held responsible where a manufacturer has not provided adequate or accurate care instructions.

10. Liability and Limitations

The Company will exercise reasonable skill and care in the performance of the Services. If the Client is not satisfied with the standard of the work, the Client must notify the Company as soon as reasonably practicable and in any event within 48 hours of completion of the Services. The Company may arrange a revisit to inspect and, where appropriate, attempt to rectify the issue.

The Companys total liability to the Client in respect of any loss or damage arising out of or in connection with the Services, whether in contract, tort, negligence or otherwise, shall be limited to the lesser of the cost of providing the Services again or the replacement value of the item damaged, taking into account age and condition, up to a maximum amount reasonably proportionate to the fees paid for the Services.

The Company shall not be liable for any indirect, incidental or consequential loss, including but not limited to loss of profit, loss of use, loss of enjoyment, loss of business or loss of opportunity.

Nothing in these Terms and Conditions shall exclude or limit the Companys liability for death or personal injury caused by its negligence, fraud, or any other liability that cannot lawfully be excluded or limited.

11. Health, Safety and Property Protection

The Company will operate in accordance with applicable health and safety legislation and will take reasonable care to protect the Clients property. The Client must inform the Company of any specific risks at the Premises, such as loose floor coverings, electrical hazards, or restricted access areas.

The Client is advised to keep children, pets and other vulnerable persons away from the work area and any equipment used by the Company during and immediately after the cleaning process. Some areas may remain damp for a period after cleaning and may be slippery until fully dry. The Client is responsible for taking appropriate precautions to prevent slips, trips or falls on damp surfaces.

12. Waste Regulations and Environmental Considerations

The Company will handle and dispose of any waste generated during the provision of the Services in accordance with applicable waste management and environmental regulations. This may include waste water, used cleaning materials and any solid residues removed from carpets, rugs or upholstery.

Where possible, the Company will minimise waste and use products that are appropriate for the surfaces being treated and mindful of environmental impact. The Client agrees not to request disposal of any hazardous or regulated waste materials unless this has been expressly agreed in advance and appropriate arrangements have been made.

The Company is not responsible for general household or commercial waste removal, building waste or other waste services beyond those directly connected with the cleaning procedure being carried out.

13. Insurance

The Company maintains insurance cover appropriate for its business activities. Details of such cover are available on request. The existence of insurance does not extend or increase the Companys liability beyond the limits set out in these Terms and Conditions.

14. Complaints and Dispute Resolution

If the Client wishes to make a complaint about the Services, this should be raised with the Company as soon as possible and within 48 hours of completion where reasonably practicable. The Company will investigate the complaint and may request access to the Premises to inspect the work carried out.

The Company will endeavour to resolve complaints amicably and promptly. If a mutually acceptable solution cannot be reached, the parties may consider independent advice or alternative dispute resolution options as appropriate.

15. Personal Data

The Company may collect and process personal data from the Client, such as name, address and contact details, strictly for the purposes of managing bookings, providing Services, processing payments and handling enquiries or complaints. The Company will handle such data in accordance with applicable data protection legislation and will not sell personal data to third parties.

16. Changes to Bookings or Services

The Company reserves the right to make reasonable changes to the methods, equipment or products used in delivering the Services, provided that such changes do not materially reduce the quality or outcome reasonably expected by the Client.

If the Client requests additional services or significant changes to the scope of work during the visit, any extra charges will be agreed with the Client before the work is carried out.

17. Amendments to These Terms

The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of the Clients Booking will apply to that Booking. A copy of the current Terms and Conditions will be made available upon request.

18. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services provided by the Company, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

19. Severability

If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed severed and the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms and Conditions constitute the entire agreement between the Client and the Company in relation to the provision of the Services and supersede any prior written or oral representations, statements or agreements relating to the subject matter.

By placing a Booking with Kingsbury Carpet Cleaners, the Client confirms that they have read, understood and agree to these Terms and Conditions.
